More thoughts on regulating rescues.

From Florida, a pit bull mix was trafficked out of Broward County to Helping Paws 22 Rescue, a 501c3 in southwest Florida.  Lilly failed her real world temperament test by attacking her current owner, her prospective owner, and her current owner's son.  Here is the Cliffs Notes version of the story per the NewsPress.com  "The dog was owned by Patricia Agnello, who runs Helping Paws, a non profit organization.  Her son, Christopher Agnello, told officers that Lilly had been playing all day, and when Shelley Loudermilk of Columbus GA., arrived to take Lilly, the dog attacked his mother and Loudermilk. Christopher Agnello stated he ran outside and jumped on the dog in an attempt to control it but the dog turned on him and began trying to attack his face.  A friend of the Agnellos, identified as Marie Wilton, called for help and then ran outside with a knife, stabbing the dog near the rib cage.  They were then able to muzzle the dog a on place it inside a kennel."  Lilly did not survive her injuries.  For more information on this attack please click here.



You can purchase this bumper sticker from Helping Paws for just one dollar.  Ms. Loudermilk was unable to complete the purchase prior to transport to a local hospital.

The Helping Paws 22 Facebook page includes a sad notice posted on August 8th.  Another rescue, OC Shelter dogs of Orange CA announced that a dog that they placed on 7/30/2013 had been returned to the group with the request that the dog be humanely euthanized because it attacked another animal in the new household.  In classic humaniac style, hysterical comments blamed the new owner and demanded identification, public shaming,  and placement on a Do Not Adopt list.  Here was the sales pitch for this dog  KOA Pet ID: A1263579 Sex: N Age: 6 Months Color: BLACK - WHITE Breed: PIT BULL - MIX

I'm sure that these groups feel strongly that they are serving the needs of unfortunate animals but in practice they put the public at unreasonable risk and must be regulated.  Emotion frequently interferes with common sense.



Some rescues have no problem with risk, others give no consideration to law.  The next two items go in that direction.  Speaking of rescues and regulation, this from the Toledo Blade regarding their favorite breed specific advocate, Jean Keating.  It must be remembered that the Toledo Blade is one of the two most pit bull friendly newspapers in the United States, both publications are owned by the Block brothers.  John Robinson Block was the recipient of the very first Hello Bully award.  A short quote from the Blade on this honor for Mr. Block.
"The group, Hello Bully, is presenting Mr. Block with the first Hello Bully Hero Award, an annual recognition of greatness in the community. Mr. Block is being commended for the work he did in Ohio with helping to change breed-specific legislation, said Nicole Meloy, director of development and events for the nonprofit group.  “We follow all [breed-specific legislation] issues very closely but especially this one in Ohio, since it was in our own backyard,” Ms. Meloy said. “We were recently made aware of John Block’s efforts in spearheading the initiative to eliminate Ohio’s BSL and were extremely impressed and grateful for what he had helped to accomplish. Any person that has that much passion about an issue, especially regarding pit bulls, is a remarkable individual in our eyes.”  
It is clear that breed specific advocacy is well aware of the tremendous influence of shameless Blade hucksterism on this issue and on the passage of  HB 14 to deregulate pit bulls in Ohio.  This bill was sold to foolish legislators as "finally giving dog wardens the tools to deal with vicious dogs."  Not so much, Ohio had four dog mauling deaths in the first year after the passage of the bill.   

But enough of that rehash and back to the Blade's favorite pit bull advocate, Jean Keating. It seems that Ms. Keating's home town, Sylvania has a zoning code regulation that limits the numbers of dogs that may be kept on a residential property.  Keating has run afoul of local law.   At the time that Ms. Keating was cited she had nine pit bulls at her home, three were her own dogs and six were fosters for Ms. Keating's organization, the Lucas County pit crew.  Current Sylvania law limits the number of dogs legally kept on a residential property to just three.

This is a short quote from the Blade that pretty much sums up Ms. Keating's thoughts.
"Resident Jean Keating questioned council recently on why she was told by Bob Oberly, zoning administrator, that she was in violation of a city ordinance limiting the number of dogs on a residential property. She told council she wanted limits on dogs removed from the code.
“I think dogs are considered property, and people should have as many as they can care for," she told council at a recent meeting."  Ms. Keating is quoted as stating that she feels that she should be able to house as many as ten pit bulls on her residential property but fails to fully understand that her current legal troubles have their basis in a complaint from a neighbor that she is not keeping the dogs she already has in a manner that makes neighbors feel safe. 

Ok now, Keating wants limits removed on her whim and she expects that this will simply happen without opposition.  She may be right, after all state law was changed to suit her tastes.  HB14 was introduced and relentlessly promoted by Keating's personal friend Representative Barbara Sears.  Sears used her position in the Ohio majority party shamelessly in order to promote the bill.  Sears partnered with an out of state animal rights PAC, allowing them to actually write the bill and to hire lobbyists to promote it.  Now the city of Sylvania is allowing Keating to submit suggestions on how local law might suit her better.  Holy cow...

Before I turn to other stories I would like to point out the photo of Keating with her three pit bulls that is found with the Blade article on Keating's refusal to abide by local law.  The dogs are named, Milo, Chief and a dog that is familiar in the Ohio Legislature, Wendy.  Wendy appeared at HB 14 hearings in the Ohio House and in the Ohio Senate.  She was introduced by Keating  "I have brought Wendy with me today. Wendy is being trained as a service animal for a young child with post-traumatic stress disorder, sensory integration dysfunction, low muscle tone, and panic attacks. Wendy was chosen because she has the temperament and physical characteristics to perform the work needed to assist this child in leading a more normal life. Those same physical characteristics currently identify Wendy as a vicious dog under Ohio law. The American Staffordshire Terrier, which is a breed commonly referred to as a pit bull type is a popular choice for a service animal because of some unique qualities. They are hardy, athletic, and very socially connected dogs. They are also very easy to train as they are eager to please."   Now it is made clear that Wendy is not a "service dog in training" she is simply one of Keating's dogs.  Was the Ohio Legislature too foolish to question the song and dance they got from breed specific advocacy or were they too corrupt to question the sell out to a well financed and organized special interest group?  



Moving along to more adventures with dog rescue.  Residents of Rittman Ohio may be sleeping a bit better.  Kristine Maxwell announced that she has closed up shop with her Presa Canario rescue in response to a health crisis with her very cute young GSD.  In comments on this thread Maxwell admits that she has five dogs of her own plus eight rescues.  She was wildly over the local limit of two dogs per residence.  For more on Maxwell's Presa Canario rescue please click here and here.  I sincerely hope this cute puppy does well for her.  I  had a young dog get a horrible diagnosis and understand her distress.  My dog did well and lived a long and full life.  I hope the same for her pup.  

From Texas comes this rescue disaster story posted by the Brownsville Herald on 8/18/2013.  A judge has decided that 240 dogs and several cats originally rescued by a group calling itself Animal Guardians of America and recently rescued from the rescue by The Denton County Sheriffs department and  the Humane Society of North Texas may be put up for adoption.  The Animal Guardians of America relinquished rights to the animals in lieu of paying fees.  A Humane Society spokesperson stated that urine and feces were "everywhere" on the property and that the property lacked proper water.  This situation was brought to the attention of local officials via complaints by citizens. 


Dog  rescues are not the only ones that run into trouble when animal lovers get in over their heads or fail to use common sense.   This story from Green Springs Ohio deals with an individual who thought she was "rescuing" cats.  Barbara Shockley's residence was raided and seventy living cats and four dead cats were removed from the home. The cats were taken to the Humane Society of Sandusky County, 34 cats were humanely euthanized due to medical conditions.  Shockley is expected to be charged with cruelty to animals, the statement was made that Shockley was not intentionally cruel but she was "neglectful."     




For my final rescue story for this post, there has been a decision on the disposition of the Effingham County GA dangerous pit bull named Kno.  For background on this story please click here.  The judge has recently decided that Kno may be trafficked to New York state.  Please note that per the Savannah Now article, Kno was turned over the the county after the attack on young Wesley Frye last year.  The county has been responsible for this dog for the last year and the legal system even provided Kno with a lawyer.  The receiving rescue, Glen Wild, has stated that they expect payment of $5000 for lifetime custodial care for this mauler.  Will Effingham County pay that bill too?  Current donations for Kno's care total only $235 as of 8/17/2013.


Hearings will be held in Ohio on a law to regulate high volume breeders.  This law will have some impact on rescues but what has been proposed is not enough.  Per the proposed law rescues must only register.  The law should allow inspection at any time, demand that county dog wardens be notified of any designated dangerous dogs to be moved into their jurisdictions prior to transport with a mandatory inspection of facilities, allow for audit of financial records, and recognize the authority of local law limiting the numbers of dogs to be housed.  The ODA did not go far enough.

The Ohio Department of Agriculture (ODA) will hold a public hearing to accept testimony on the proposed new administrative rules that relate to the regulation and licensing of high-volume commercial dog breeders.  The hearing will be held on Thursday, August 29, 2013.  It is important that those parties who may be regulated review the proposed regulations and provide comment to ODA.  
BACKGROUND:  In March, Ohio enacted a new law that defines “high volume commercial dog breeders” as anyone who both produces nine litters of puppies AND sells 60 dogs or puppies in a calendar year. Both criteria must be met to be subject to the licensing and other requirements.
Rescues are also required to be registered with the state if they keep, house, or maintain dogs in Ohio. This includes those who coordinate rescue efforts in the state. Rescues will not be required to comply with the proposed regulations for high-volume breeders, but must still complete and submit a registration form.
MEETING INFORMATION:  The hearing will be held on Thursday, August 29, 2013, at 9AM, in Hearing Room 133 (Seminar “B”) of the Bromfield Administration Building, 8995 East Main Street, Reynoldsburg, OH 43068-3399.  Any person affected by the new rules may appear at the hearing and be heard.  Any person who wishes to present his position, arguments, or contentions in writing, other than at the public hearing, may do so by mailing their written comments to:

Lets send vicious dogs to Ohio and put them on Petfinder!

You know how sometimes you look at a situation and you think "this is bad" but it actually turns out to be even worse?  Boston the two time mauler Presa Canario in Ohio is just like that.  To refresh your memory, please click here.

Before I get too far into this post I would like to give you the thoughts of someone else on this topic.  Here are the words of Dog Bite Attorney Ken Phillips, written last year after the death of Rebecca Carey.

Adoption and Rescue Groups Should Be Licensed

A college student who had a passion for rescuing dogs is dead, killed by the same dogs she wanted to save. (See Rebecca Carey, Georgia Student, Killed by Dogs She Rescued.) The breeds of the dogs are interesting: two pit bulls, a boxer mix and two Presas.
All rescues. She was out to prove a point, namely that breeds known for their violence toward people can be tamed with enough loving care. Unfortunately she was going about it the wrong way. One of those dogs, in the hands of a skilled behaviorist, would be risky enough during the training, and would remain a safety hazard afterwards. But trying to deal with 5 of them at once? 
Remember, a rescue dog is an abandoned dog. One must wonder why the dog was abandoned. Was there a reason why it was sent to the animal shelter? It is folly to assume that only bad people abandon their dogs. When a dog is violent toward people, good parents, good animal control officers, and good cops send the dog to the shelter. Not all abandoned dogs are good dogs. 
As one of many rescuers who have been injured or killed by dogs in the recent past, Rebecca Carey has helped to prove two other points. One is that we need to enact restrictions on the number of dogs that can be kept at a residence. 
There are laws that forbid people from having more than a certain number of dogs. Generally these are considered to be zoning restrictions but such laws also are safety laws. Not only for the safety of the person who has the urge to hoard animals, but also for the safety of friends and neighbors. It has been established that there is a pack instinct in dogs and that normally docile dogs can become aggressive toward humans when the dogs act in concert. For that reason, and to prevent a person from going out on the street with 5 leashes attached to 5 muscular dogs, I have urged the enactment of laws restricting the number of dogs that can be present at a residence, with the number being sharply reduced in the case of larger, more muscular dogs, including pit bulls, Presas, Rotties and the like.
The other point is that adoption and rescue groups need to be licensed.
I am hearing, almost daily, about unsuspecting people who adopt a dog, get attacked by the dog, and then learn that the adoption organization knew that the dog was violent toward people but did not provide a warning about the dog. People like Rebecca Carey -- I call them "humaniacs" -- do not recognize the dangers inherent in such dogs. For that reason, I am urging the enactment of laws that regulate adoption organizations, to the extent necessary to make all of them accountable and to prevent the humaniacs from recycling known dangerous dogs into communities.

.Back to our topic, Boston the California Presa Canario.  After attacking the same five year old child twice, sending that child to the hospital for treatment both times, Boston was declared dangerous and ordered out of town (Pleasanton California) or to be euthanized.  Boston's owner, Marc Kornberg, chose to send Boston to a "rehabilitation  and training facility" in Rittman Ohio.  Why Ohio?  We will talk about that in another post

Boston's new home has in the past been called Utopia Kennel, Utopia Rescue and Rehabilitation, and now Presa Canario Rehabilitation and Rescue Center.  All fabulous names but the reality is a small private home in a community with a two dog per residence limit.

And you must have experience with this breed..not just have been around them you must have owned one.He is one of the best presas ive ever had the pleasure of meeting and someone will be very lucky to get him.Hes comepltly vetted...no out of state adoptions for Boston.If your interested in adoption or meeting Boston please call or email for more info on him and how he came to be at our rescue.

Boston "prefers" a home without cats, dogs, or children.  If such a home exists, do you think that possibly the neighbors might have cats, dogs, or children?  Might the neighbors have a concern about Boston moving into the neighborhood?  I think they might, and given the information not shared, the neighbors will have no idea what is coming. 


Kristine Kay Maxwell's neighbors might have a clue.  Maxwell lives in a community with a two dog limit per household which Maxwell feels should not apply to her.  For a link to a news story about her legal troubles please click here.  At the time the article was written Maxwell was four dogs over the limit.

Friends, this is very upsetting to us. The pack and I are very upset to hear that our good friend Kristine Maxwell is having a problem with the city of Rittman, Ohio (Wayne County). They are giving her a hard-time about helping dogs and listening to some people that are not very nice.
Kristine always helps dogs people would not want because they are less than perfect in some folks eyes! One of the rescues got out and ran down the street, and when the police returned the dog they saw she had over the 2 animal limit. She stated that they were rescues and are currently looking for homes but they didn't care and told her that they had to go or she would be charged $150 for each one over the 2 allowed each day. SHe steps up and helps so many dogs in need as an interim home until a foster can be found. I can't even count how many dogs who would have been dead if it wasn't for her.

Here is a link to the Petfinder listing for Maxwell's Presa Canario Rescue and Rehabilitation Center.  Please read it carefully, ignoring the obvious spelling errors.  Maxwell will take any Presa Canario with behavior issues for a $100 surrender fee and quickly list the dog on Petfinder with a $300 adoption fee.

Interestingly, Maxwell states that she will not place these dogs with families including children under 13 years of age.  Maxwell has children in her home, the youngest is 7 years old.  Do Maxwell's children have friends over to visit?  Do the parents of those children have a clue what Maxwell has in her home?   Keep in mind that Boston is uninsurable after two attacks and a dangerous dog designation in the state of California.

An article from the Pleasanton Weekly discussed Boston's attacks on the child and felony charges against Boston's owner and the child's mother.  Comments got interesting and specific on Maxwell's Rehabilitation and Rescue Center.    These two comments obviously got under her skin.

This dog is not going to a dog rehab and the judge and Ac were prewarned of what type of place this aggressive dog is going to. They don't care it is out of their hands now and out of their state. They should be ashamed for putting the Ohio community in danger. I hope the Ohio news picks up on this real quick and looks into what qualifications this person has to be a behavioral trainer of a human aggressive dog, look where the animal will be kept and know that said person is already over the legal limit of animals in her care as well as how many times her children have been biten and it has gone unreported to the authorities. I pray this dog does not get out like so many have , that have been running at large from her so called rescue. The Judge should be ashamed because even the AC recommended the dog be pts. Any dog that bites a child not once but twice in the face is aggressive. It does not matter if the child hugged the dog that is not cause for a dog to bite a child. I also agree the owner and the parent are at fault but something should have been done the first time. I hope all her supporters reading this thread start looking into who and what you are supporting because you do not know what type of person you are dealing with.

The constant bickering on here is not only immature but its unnecessary.Im the one who owns the rescue where Boston is.It was my decision after much research on this case to bring him here to my rehab facility.I don't want anyones approval here cause this is my rescue and ive ran it successfully for 23 years and I definatly don't want anyone speaking on my behalf which is why im reluctantly posting this.Ive been a part of this case since the day after the bite happened,and not just with the owner but with the magistrate,Sheriff,and animal control officer.Boston is not a vicious dog or he would never have been released to me and he will be rehomed when I see fit in an adult only home..which is the case for all adult dogs we rescue.Ive had presas my whole life and like pits,rotties or any other breed if there with an uneducated owner they can and will get into trouble.They like all the others are not born mean.If you havnt owned one don't judge one cause of a paragraph you read on google.I have more than 20 yrs experience with behavior modification so im fully capable of making the decision to rehome this dog or not and after all the stress hes been under hes been nothing but a very sweet dog the first few days hes been here(which can be when they show the most aggression if there going to).On Boston page on my petfinder it clearly states no children in several places.not just on his bio but my main page also.It also states to email for the info in how he came to be at the rescue which we write this often as most of the dogs we get at the rehab center have bitten a human or another animal and no dog with a bite history is ever adopted out without the adopter knowing 100% of the entire situation .Its a small bio not room to write a story and its something id rather say than type.My rescue started 22yrs ago and was called Utopia..the reason it was changed was to mnay people thought we were an all breed rescue and no one new there was a rescue for presas..no hidden agenda there just a name change to help the shelters find us.There is no fb page for my rescue and hasn't been for a long time cause I have zero tolerance for drama and that's all rescue is.I don't need fb to justify my rescue..my experience and many wonderful references speak for themselves.I would never adopt out a vicious dog or a dog I thought was a danger to the public,i have kids to.Boston has been evaluated by several people and even at the shelter shown nothing but kindness to comeplete strangers.My own dogs wouldnt be as behaved as he has been if they went through what he did.Its disturbing the lies being posted on here..and more so about my kids.Its really sad that no one has yet to call or email me personally but would rather post things publicily that they cannot prove.All my contact info Is on my petfinder...my home has always been open to anyone so if anyone has doubts about my rescue,me or boston feel free to email,call or come over.We are very proud of what we do,how hard we work and the rescue weve built and always welcome visitors.And if my name isn't on a post here its not from me so please don't assume it is.I will not respond or post here 

This woman has difficulty with her own life timeline, and paints herself a victim because local officials have the audacity to remind her that the law says just TWO dogs per household while she feels that six dogs suits her style better.  She feels that it is her right to transplant out of state maulers into Rittman Ohio and is offended that others disapprove.

For a final insight on Maxwell we will take a look at her Facebook page.  Maxwell is telling another Facebook user to buy a bogus service dog vest on eBay, instant "service dog" and the photographs are hers.  Maxwell might consider that the purchase of a vest on eBay does not constitute actual "service dog" status.  Maxwell is instructing the Facebook user to violate Federal law.  For those keeping score, Maxwell has repeatedly broken local law by keeping far more dogs than local law allows and for failing to contain those dogs. Maxwell has broken state law, Boston is a declared dangerous dog in California and has been trafficked at Maxwell's request to Ohio and is uninsurable. Dangerous dogs must be insured.  Maxwell is in violation of Federal law for falsification of service dog status.  This is the very woman who has decided that it is her right to peddle this dangerous dog on Petfinder, as a pet, to an Ohio resident.  God help us all.

Does this look like a good thing for Ohio?

An article from the San Francisco Chronicle, dated  6/8/2013 gives details on two attacks by the same dog, on the same child.  The dog is Presa Canario owned by Marc Kornberg.  The child is the son of a female visitor in Kornberg's apartment.  On March 6th of this year the child had been left alone in a room with the dog and was bitten in the face requiring hospital treatment.  At that time the dog was temporarily placed in home quarantine.

On May 19th the same child was left alone in a room with the same dog with the same result.  The child was again treated at a local hospital.  This time the dog was seized.  Both Kornberg and the child's mother, Myrvete Lila have been charged with felony child endangerment.  

The dog was sent to an unspecified "rehabilitation and training facility" in Ohio.  Was the appropriate County Dog Warden notified that this proven dangerous dog had been sent to his jurisdiction?  What kind of containment does this unspecified facility offer?  What are the qualifications of the person who will be "training and rehabilitating" this known dangerous dog?  What is the ultimate disposition of this dog?  Will it be placed in an Ohio community exposing Ohio children to the same danger that injured a California child, twice?   

These questions should be answered.  The Bones affair exposed the dangers of trafficking dogs with a violent history across state lines for the purposes of rehabilitation and and/or sanctuary care.  To refresh your memory.

Someone posting a comment on this article on the Pleasanton Patch claims that the dog will /has been sent to a facility in Rittman Ohio.  That would be Wayne County and the County Dog Warden is Nate Broehl.

Sad that the dog is going to be going into a bad situtation and now the whole neighbor hood will be in danger and have to watch their children.The judge was advised of what was going on at this so called facility and rehabiltation center. Rittman Ohio please keep your kids safe.
