Life in Ohio, thanks Barbara Sears!

These are true stories, sent to the blogger at Craven Desires and forwarded to me.  The writer gives us a peek at how the passage of HB 14 has impacted peaceful Ohio residents.  Please remember that HB 14 was sold to foolish and/or corrupt Ohio lawmakers as a means of giving Ohio Dog Wardens the "tools to deal with vicious dogs."  We see no evidence of this so far.  Here is what peaceful Ohio residents actually experience thanks to Barbara Sears and her relentless, thoughtless, but well funded sell out to pit bull advocacy.  The writer was willing to have her stories told here unedited except for removing identifying locations.

"My son would be dog meat now if it weren't for me having wasp spray handy two days ago.
I would have had my camera out if I wasn't trying to blind a pit bull. My son is terrorized. Absolutely terrified

He was crying so hard and shaking behind me when the pit bull tried to eat him on Oct 25th. Thanks to me wielding pesticides he is alive and not hospitalized.  I am gonna start wielding a knife in my purse and a camera. I want to help. I just could not grab a camera these last two times because the fear of being bit or having my son attacked was overwhelming.

Hey I have so much to share with you. I live in XXXX Ohio  (a large city in northeastern Ohio) .  Meth capital of the country and now pit bull haven. There are dozens of these dogs on every block. No exaggeration.  1 block away in one direction there are about 11 pit bull dogs between 3 families.  On this block there are 4 adult pit bull dogs and about 3 pups. Another block in the other direction there are pits and a cane corso. At least one cane corso. I can go on and on with the number of pit bull dogs that live within 5 blocks radius of my home. I can no longer walk or drive safely anywhere without spotting pit bull dogs.
To start I don't always think about pulling out my camera when I am faced with a frightening thing. Sometimes my mind goes blank and my body goes into action. So unfortunately my pit bull encounters are undocumented. 

My husband was driving myself and our three boys in our van to the store. As we turn a corner going down a side street we've always utilized to avoid traffic, we come upon a street wide pit bull fight blocking the lane and our van. There were between 7 and 9 dogs fighting (pit bulls) in a kind of dog pile line. Like they formed a line from one curb nearly to the other. Dogs gripping dogs on top of dogs. It was chaos. To this day I regret not recording the entire scene. People were trying to pull the dogs loose and getting bit in the meantime.  We revved up our engine and the dogs didn't budge instead continued to maul each other and surrounding humans. All the humans were the dog owners.  So I don't feel sorry for them. Anyway we were going to drive right through the pit bull fight line dog pile thing but we didn't want to hit any people. That'd be a nasty thing to file with the insurance company.  Being completely delayed in our trip we went another route and called the cops and reported dog fighting. 
The next encounter was worse. I am walking my son home from the store. It is a cool October day so we stop into a convenient store for hot cocoa for him and coffee for me. We are walking home hand in hand, arms laden with bags and chit chatting.  He is 5 years old. We reach this tall church near the entry to our street and we hear a loud menacing growling. I can't see the dog at this point but I pull my son close to me and stand still. I see it a big grey pit bull pounce from its front porch hair on its back straight up. I call to the owners to grab their dog. But no adults are in sight just children.  The oldest is 10 at most. He is freaking out and nobody can get the dog. He is pleading with me that the dog won't bite. She charges for my son... I pull out my was spray and blast this bitch in the eye. She runs off in the other direction and my son and I make it home safely. I call the pound and nothing has been done since we were not attacked."

Hey I haven't corresponded with you in awhile. My life was topsy turvy for a good long time and Facebook was acting up. I attempted to send you a story about pit bulls gone wild here in XXXX ever since Ohio legalized pit bulls we can't walk half a block without seeing their ugly mugs.  And instead of being incredibly well behaved peaceful pups smoking peace pup pipes they are a menace at least."

(The writer tells the story of the pit bull street fight again but gives additional details.)

"Two blocks away there are three "families" or households that own somewhere in the range of 9-11 pit bulls all together. Well one day 9 of those freaking crazy animals all got out of their homes and yards and had a street wide dog fight. People were screaming and freaking out. The reason I know this is they were blocking traffic. It wasn't reported but we called the cops and the cops never showed up

They were in a literal dog pile. Dog on top of dog. Two dogs were locked in each others jaws. Like one dog sunk his teeth into the other dogs lower lip. And was locked on. There were other pit bulls some smaller some larger all just piling on each other and biting. Some people got bit but it was the owners not any innocent bystanders. I was in my van. The dogs were blocking traffic so I took another route but was totally inconvenienced.
The people had break sticks and weapons the biggest male owner was slapping the shit out of one dog and trying to pull it away from the fight but it bit the fuck out of him and got back in the mix.
It was 9 pit bulls. My husband and I counted to be sure. 9.

Then my mom and I were walking to the bus stop to get my son. A menacing white and black pit bull was sitting just inside a glass door. My mom said something and I said "that bitch is crazy. She told me to my face that the dog is vicious and even growls at her kids. There is no way I'd keep a dog in my house that growls like that" so this lady's neighbor comes to the defense of the dog I said "Bro this conversation was A B and you were not invited to comment. Your girl told me that the dog is mean. In her own words so mind your own business. I didn't ask you"

In fact her kids tell me the dog is mean. They are afraid of it. So she's just lacking common sense
Anyway those are my pitnutter stories. I know you can't use them over at cravendesires since I don't have proof or a source but I thought I'd fill you in on what good Ohio's law for pit bulls is doing to our neighborhoods and kids."

Be careful what you ask for

Breed specific advocates make the same statement after every serious attack.  The dog owner is responsible, the dog is not to be blamed. "The POOR dog will pay with his life for the irresponsibility of the owner."

Congratulations pit bull advocates, you are beginning to get exactly what you want, these pit bull owners are being held responsible.  They have been charged and some of them have gone to trial.

Edward Daniels Jr., owner of the two pit bulls that killed seven year old Tyler Jett, was found guilty of manslaughter after just two hours of deliberations and sentenced to ten years in prison, five years probation,  and ordered to pay $1000 in fines and $5000 for Tyler's funeral expenses.   It is not enough.

Incredibly, Daniels family fells that he should never have been sentenced.  Per wjhg.com "However, Daniels' family says he shouldn't have been sentenced at all.

His family said, "They needed the 'fall guy' for the death of a child and the dogs weren't enough."

Marco Zamudio, uncle of two year old Samuel Zamudio, has been charged with child endangerment (a felony) in the mauling death of little Samuel by a pack of family pit bulls.  Marco was babysitting Samuel but was asleep while Samuel was mauled to death by the family pit bulls.  Samuel's grandmother, Eustulia Zamudio, 42, the owner of the home and the dogs, was also arrested, but San Bernardino County prosecutors decided there was insufficient evidence to charge her.

Summer Laminack , mother of 21 month old  Monica Laminack, was charged with second degree cruelty to children in the mauling death of Monica.  Monica was mauled to death by the family's seven pit bulls. Summer faces up to 10 years in prison.

Jena Marie Wright, babysitter of four year old Jordyn Arndt was charged with child endangerment resulting in death and will  stand trial.  Jordyn was mauled to death by Wright 's pit bull.

Alex Jackson, owner of the pack of pit bulls that mauled 63 year old Pamela Devitt to death, has been charged with murder and faces possible life in prison.

It should be noted that Riverside County California has recently passed mandatory neuter and spay regulations for pit bulls in response to many serious attacks, including the deaths of Samuel Zamudio and Pamela Devitt.

Steven Hayashi was charged with involuntary manslaughter in the mauling death of his two year old step-grandson Jacob Brisbee.

A law proposed in England and Wales would send owners of dogs that fatally attack a human to prison for life.    It will be interesting to see how this progresses.

Pit  bull owners make their own choices and must be held responsible for them. Incarceration will not bring the dead back or pay the medical bills but it may send a message to prospective pit bull owners.  The deaths of the innocent will no longer be tolerated.

These pit  bull owners don't have to worry about making a fashion statement, an orange jumpsuit is their only choice.  Orange is the new black. 

The forgotten service animal.

Here we are, halfway through Pit bull Awareness Month and up to our clavicles in feel-good advocacy articles on Nanny Dogs and Service Pits but the true service animal has been totally ignored.   Google Nanny Goats and you will have 115,000 results in 0.08 seconds.  You might not be aware that goats were also trained to help soldiers during WWll.   Yes, the term "nanny" goat was coined during WWll, as goats were used by the military to help care for wounded soldiers, as well as watching orphan children.

Two fathers speak but pit bull advocacy does not listen

Given the pit bull mauling deaths of three toddlers in a recent five day time frame it might be of value to listen to the words of two fathers who lost toddler sons to pit bull attacks earlier this year.

Jeremiah Rutledge was interviewed by WSB TV.  His son, two year old Beau was killed by the family pit bull on April 24, 2013.  Mr. Rutledge asked "“How do I go from a birth certificate to a death certificate?” 
He said his faith is getting him through, but he offers words of caution for those with small children around pit bulls.
“Those dogs cannot be domesticated. They cannot,” 

Beau Rutledge, killed by Kissy Face, the family pit bull.  Kissy Face was owned by the Rutledge family for 8 years without any aggression until she killed Beau.   This family did nothing wrong, they did exactly what pit bull advocacy wants families to do, give a pittie a chance. Please keep the words of these two fathers in mind when you read the next Death and Excuses post.   Since Death and Excuses, part 3 was posted on 7/1/2013 four Americans have been mauled to death by pit bulls.  Three children and a 96 year old man have died.

How many children are enough?  How many children need to die before Jane Berkey, Ledy Vankavage, and Karen Delise acknowledge the  reality of the breed they whitewash?

Jeremiah Rutledge has seen the reality "These dogs cannot be domesticated.  They cannot."  Jeff Borchardt has seen the reality "Believing the myth, 'its not the breed, its all how you raise them' is what left us without a son."  

How do Berkey, Vankavage, and Delise wash the blood off their hands?  

I thought I was done with the Bones story, I was wrong

I was sure that I was done with the freak show that is the Bones affair but I was so wrong.  The insanity marches on.

Lets start with the Fourth Amendment  ""The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
This quote comes from Laws.com "The Fourth Amendment specifically requires a law enforcement agency to possess judicially sanctioned search and arrest warrants, which are supported by probable clause, to be administered before a person’s property can be inspected."

This quote comes from PINow.com  describing what a Private Investigator cannot legally do.
Trespass.  Private investigators cannot enter a property, house, or building through illegal means, including breaking and entering.  Though trespassing laws very from state to state, in some jurisdictions the investigator must have permission from the owner before entering a property.

The searches of the property formerly known as the North West Ohio Underdog Rescue were not headed by law enforcement with a valid court order.  The searches were not headed by a Private Investigator with permission by the owner, in this case Kat Sutter. Neither of these professions had the right to trespass on private property to search for evidence of a crime without a valid court order.  Why would the Lexus Project authorize trespass and search of private property by ordinary citizens and expect that any evidence found would be admissible in court proceedings against Kat Sutter?   The Lexus Project is made up of lawyers, why might they feel that they are above the law?   As disgusting as Sutter may be, she has legal rights.

Now that the illegal search of Sutter's property is complete the Lexus Project wants the public to fund the analysis of the illegally obtained remains of dogs that they did not own taken from property where they had no legal right to search.  The Lexus Project has set up a chip-in page for just this purpose.

The Lexus Project has continued to post details on their public Facebook page. Details of exactly how the Lexus Project intends to proceed indicates that the public is expected to foot the bill for legal action as well as necropsy costs.  In  a comment on the necropsy chip-in post a question is asked about setting up another chip-in to pay for a lawyer to "put (Sutter) away for a long time and ban her from ever having animals again." The response from the Lexus Project?  Business as usual.

The Lexus Project, Legal Defense for Dogs Right now the humane society is doing an investigation. If we need an attorney, we have one pro bono on stand by and would only need to collect for court fees as we do our usual cases.

In comments following a discussion of the death of another dog in the possession of North West Ohio Underdog Rescue The Lexus Project had this to say. "This is not about who sent her where, this is not about we save dogs that bite or are deemed dangerous and people don't like it, this is not about TLP stance on greyhound racing in the USA, this is about 2 dogs reported missing by the very person who vowed to care for them, only to be found mutilated in shallow graves in her backyard.

There you have it.  The Lexus Project is well aware that their actions are not supported by the public.  "This is not about we save dogs that bite or are deemed dangerous and people don't like it."

Nope, the public sure doesn't like it and the public would like Lexus Project to "get their priorities straight." The goals of the Lexus Project are clearly out of touch with the priorities and safety of the public.

Update 10/3/2013  Please click here.  Per Northwest Ohio.com "Greg Willoughby of the Toledo Area Humane Society says his agency is investigating Ms. Sutter.  Willoughby is concerned that the Lexus Project's actions Wednesday night at Ms. Sutter's Luann Avenue home may hamper the investigation.  "It may make our case more difficult because we weren't there to witness it, our veterinarians didn't see the animals and our officers weren't part of it,"

Update 10/8/2013

This is what we may expect to see from any attempt to prosecute Kat Sutter using evidence removed from her property by volunteers sent by the Lexus Project without a court order. Let me set this up so you can follow the story.  Lee Coleman Krisle will go free after a judge ordered that key evidence must be suppressed.  Krisle was charged with eight counts of animal cruelty.

Per the Tennessean " The animal cruelty case against Robertson County businessman Lee Coleman Krisle has been dismissed after a judge ordered that most of the key evidence in the case be suppressed."
“I felt we did not have enough evidence to take what was left of the case to a jury,” said Robertson County Assistant District Attorney Dent Morriss. “So, I reluctantly dismissed it. At least we were able to get the animals that were there out of the situation they were in.”" Krisle, 55, was charged with eight counts of animal cruelty in February. His original indictment, handed down by the Robertson County Grand Jury, claims that he failed to provide needed food and water, along with proper shelter and care for eight animals – seven horses and one mule. Documents also describe the mule as having an injured leg with wire wrapped around it."

"At an August court hearing, Robertson County Judge Michael R. Jones ordered that evidence collected during a search of Krisle's property could not be used in trial because the search warrant was not valid, according to court documents.

The warrant was thrown out because an employee of the Humane Society of the United States signed it, but the employee was not authorized to do so, according to Krisle.  The rules of criminal procedure require that search warrant applications be made by law enforcement officers."

10/9/2013 update.  No charges will be filled against Kat Sutter.  Per the Dayton Daily News the executive director of the Toledo Area Humane Society  stated there is "insufficient evidence" to press charges.
